Terms of Service

The rules and conditions that govern your use of the Clicktocall.ai platform and services.

Effective date: March 1, 2026

1. Acceptance of Terms

By accessing or using the Clicktocall.ai platform, website, APIs, widgets, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and "you" refers to both you individually and that organization.

If you do not agree with any part of these Terms, you must not access or use the Service. Your continued use of the Service following the posting of any changes constitutes acceptance of those changes.


2. Account Terms

To use certain features of the Service, you must create an account. When creating and maintaining your account, you agree to the following:

Clicktocall.ai reserves the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period, subject to reasonable notice where practicable.


3. Acceptable Use

You agree to use the Service only for lawful purposes and in compliance with all applicable local, national, and international laws and regulations. You may not use the Service to:

Clicktocall.ai reserves the right to investigate and take appropriate legal action against anyone who violates these provisions, including removing content and suspending or terminating accounts.


4. Service Level

Clicktocall.ai strives to provide reliable and uninterrupted access to the Service. However, the Service is provided on an "as available" basis, and we do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components.

We may perform scheduled maintenance that could temporarily affect availability. We will use commercially reasonable efforts to provide advance notice of planned maintenance windows. Emergency maintenance may be conducted without prior notice when necessary to protect the integrity of the Service.

For customers on paid plans, specific service level commitments, including uptime guarantees and remedies for downtime, are described in the applicable Service Level Agreement (SLA) provided as part of your subscription. In the event of a conflict between these Terms and your SLA, the SLA will govern with respect to service availability commitments.


5. Intellectual Property

The Service, including its original content, features, functionality, design, trademarks, logos, and all associated intellectual property, is and will remain the exclusive property of Clicktocall.ai and its licensors. The Service is protected by copyright, trademark, trade dress, patent, and other intellectual property laws of applicable jurisdictions.

You retain ownership of all data, content, and materials that you upload to or transmit through the Service ("Your Content"). By using the Service, you grant Clicktocall.ai a limited, non-exclusive, royalty-free license to use, process, store, and display Your Content solely to the extent necessary to operate and provide the Service to you.

Nothing in these Terms transfers any intellectual property rights from one party to the other, except as explicitly stated herein. You may not use the Clicktocall.ai name, logo, or branding in any manner without prior written consent.


6. Limitation of Liability

To the maximum extent permitted by applicable law, Clicktocall.ai, its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, goodwill, or business opportunity, arising out of or related to your use of or inability to use the Service, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory.

In no event shall the total aggregate liability of Clicktocall.ai for all claims arising out of or related to these Terms or the Service exceed the greater of (a) the amounts you have paid to Clicktocall.ai in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred US dollars (USD $100).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, the limitations set forth in this section shall apply to the fullest extent permitted by law.


7. Termination

You may terminate your account at any time by contacting us at support@clicktocall.ai or through the account settings in your dashboard. Upon termination of your account, your right to access the Service will cease immediately.

Clicktocall.ai may suspend or terminate your access to the Service, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. We will make reasonable efforts to notify you of the termination and the reasons therefor, except where prohibited by law or where notice would compromise the security of the Service.

Upon termination, all provisions of these Terms that by their nature should survive termination shall remain in effect, including ownership provisions, warranty disclaimers, indemnification obligations, and limitations of liability. Any outstanding fees incurred prior to termination remain payable.


8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the federal or state courts located in Wilmington, Delaware, and you consent to the personal jurisdiction of such courts.

Notwithstanding the foregoing, Clicktocall.ai retains the right to seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of its intellectual property rights or confidential information.

If you are located in the European Economic Area, the United Kingdom, or Switzerland, any disputes shall be resolved in accordance with the applicable consumer protection laws of your jurisdiction of residence, to the extent required by mandatory local law.


9. Changes to Terms

Clicktocall.ai reserves the right to modify or replace these Terms at any time at our sole discretion. When we make material changes, we will notify you by posting the updated Terms on this page and updating the "Effective date" at the top of this document. For significant changes, we may also provide additional notice through the Service interface or via email to the address associated with your account.

Your continued use of the Service after any changes to the Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and, if applicable, terminate your account.

We encourage you to review these Terms periodically to stay informed about any updates. Previous versions of the Terms will be archived and made available upon request.
